These Terms of Service (the "Terms") govern your use of www.plutoretail.ai (the "Site"), which is operated by Pluto Consulting Services LLC, a New Jersey limited liability company ("PLUTO", "we", "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. What the Site is

The Site describes how PLUTO helps businesses add AI to the systems and products they already run, including our products and integrations. It is for general information. It has no user accounts and does not sell anything online.

2. Using the Site

You may use the Site for lawful business purposes. You agree not to:

  • use the Site in a way that is unlawful, harmful, fraudulent or infringes anyone's rights;
  • try to gain unauthorized access to the Site, our servers or any network connected to them, or probe, scan or test their security without our written permission;
  • interfere with or overload the Site, or use bots, scrapers or other automated means to copy it or to send automated submissions through the contact form;
  • upload or send malicious code, or send us spam;
  • pretend to be someone else, or give false information in the contact form.

We may block access to the Site, or limit your use of it, if we believe you have broken these Terms or put the Site at risk.

3. Contact form and enquiries

When you send us a form submission or an email, you are asking us to contact you about our services. This does not create a contract, a consulting or professional relationship, or any obligation for either of us. We may or may not reply, and any offer from us is subject to a separate written agreement.

Please do not send confidential business information, trade secrets, personal data about other people, payment card numbers, government identification numbers, health information or passwords through the form. Anything you send us through the Site is treated as non-confidential unless we have agreed otherwise in writing, subject to our Privacy Policy. If you need us to sign a confidentiality agreement first, tell us in your message and do not include the confidential details.

4. Information on the Site

We try to keep the Site accurate, but it is provided for general information only. Descriptions of products, features, integrations, results and industries are illustrative, may change, and are not an offer, a promise of availability or a guarantee of results. Specific work, pricing, delivery and support are set only by a written agreement signed by us.

The "Ask PLUTO" feature on the Site is a scripted demonstration. The questions, answers and figures it shows are sample content created to illustrate how AI inside PLUTO products works. It is not live output from a real system, is not advice, and should not be relied on. Any AI feature we deliver to you will be described in, and governed by, a separate agreement.

5. Intellectual property

The Site and its content, including text, graphics, logos, designs, product names, software and code, belong to PLUTO or its licensors and are protected by copyright, trademark and other laws. PLUTO, PLUTO AI and related product names and logos are trademarks or brand names of PLUTO. You may view the Site and share a link to it, and you may print or save pages for your own internal business use. You may not copy, modify, sell, reverse engineer or build derivative works from any part of the Site, or use our names and logos, without our prior written permission.

If you send us feedback or suggestions, you allow us to use them without restriction and without owing you anything.

The Site links to other PLUTO sites and may link to third-party websites. We do not control third-party sites and are not responsible for their content or practices. A link does not mean we endorse them. Your use of those sites is at your own risk and under their own terms.

7. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. We do not promise that the Site will be uninterrupted, secure or free of errors or harmful components.

8. Limitation of liability

To the fullest extent permitted by law, PLUTO and its members, managers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising out of or connected to your use of, or inability to use, the Site. Our total liability for any claim relating to the Site is limited to one hundred US dollars (US$100). Some jurisdictions do not allow certain limits, so some of these limits may not apply to you.

9. Indemnity

You agree to defend and compensate PLUTO against claims, losses and costs (including reasonable legal fees) that arise from your misuse of the Site or your breach of these Terms.

10. Changes to the Site and to these Terms

We may change or remove any part of the Site at any time. We may update these Terms from time to time. When we do, we will change the effective date above. Using the Site after the Terms change means you accept the updated Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. Any dispute about these Terms or the Site will be brought only in the state or federal courts located in New Jersey, and you and PLUTO consent to their jurisdiction. Before starting a claim, please contact us so we can try to resolve it informally.

12. General

These Terms, together with our Privacy Policy, are the entire agreement between you and PLUTO about the Site. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a sale or reorganization of our business.
